These Terms of Service form an agreement between you and LAN Technology Limited for use of the FlyElephant VPN / FXVPN website, applications, accounts, subscriptions, and related services. By accessing or using the service, you confirm that you have read and agree to these Terms and the Privacy Policy.
1. Eligibility
You must have the age and legal capacity required to enter a binding agreement where you live. If you use the service for a company or other organisation, you confirm that you may bind that organisation.
2. Accounts and security
Provide accurate information, protect your credentials, and accept responsibility for activity under your account. You may not sell, rent, transfer, or share an account beyond plan limits or bypass device and account controls. Notify official support promptly of unauthorised use.
3. The service
We provide connectivity applications, server selection, subscription management, and support. Platforms, regions, servers, speed, and features may change because of devices, networks, maintenance, law, or third parties. We may adjust the service for security, capacity, or improvement and will seek to minimise material adverse effects on active subscriptions.
4. Lawful and acceptable use
You must follow laws that apply where you live and use the service. You must not use the service to:
- Violate rights, commit fraud, harass or threaten others, or distribute unlawful material;
- Attack, scan, compromise, or disrupt systems, or distribute malware;
- Send spam, manipulate traffic, or evade sanctions, export controls, or legal restrictions;
- Access accounts, data, copyrighted material, or restricted services without authorisation;
- Resell the service, share accounts beyond plan limits, or bypass bandwidth, device, subscription, or security controls;
- Create legal, blocking, or security risk for us, infrastructure providers, or other users.
5. Subscriptions, payment, and renewal
Price, term, device allowance, and traffic allowance are shown at purchase. Purchases through an app store or third party also follow that providers payment, renewal, and refund rules. Except where required by law, the purchase page, or channel rules, fees for periods already provided are generally non-refundable. Cancel auto-renewal through the relevant channel before the renewal date.
6. Trials and promotions
Trials, discount codes, bonus periods, and promotional plans may have additional eligibility and time limits. We may reject repeated, fraudulent, or abusive promotion use and withdraw improperly obtained benefits.
7. Software licence
While you comply with these Terms, we grant a limited, non-exclusive, non-transferable, revocable licence to install and use official applications. Except where law expressly permits, you may not copy, modify, reverse engineer, sell, create derivative works, or remove rights notices.
8. Third-party services
App stores, payment providers, external websites, and third-party platforms operate independently. We do not control their content, availability, or privacy practices, and your dealings with them follow their terms.
9. Suspension and termination
We may limit, suspend, or terminate service for non-payment, security risk, fraud, material or repeated Terms violations, legal requirements, or risk to the service. Urgent action may occur without advance notice; otherwise, we will explain the reason where reasonably practical. You may stop using the service and cancel future renewals through the purchase channel.
10. Availability and disclaimers
We provide the service with reasonable skill and care, but internet providers, devices, third parties, and regulatory conditions can affect speed, location, content availability, or continuity. To the extent permitted by law, the service is provided as is and as available. We do not promise uninterrupted or error-free operation, absolute anonymity, suitability for every purpose, or access to any particular third-party content.
11. Limitation of liability
Nothing excludes liability that cannot lawfully be excluded. To the extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential loss, or loss of profit, revenue, business, data, or goodwill. Our aggregate liability relating to the service is limited to the amount you actually paid for the relevant service during the twelve months before the event giving rise to the claim.
12. Indemnity
Where permitted by law, you are responsible for reasonable losses and costs resulting from third-party claims caused by your unlawful use, breach of these Terms, or infringement of third-party rights.
13. Changes
We may update these Terms for service, legal, or security changes. We will provide reasonable notice of material changes through the website, application, or another appropriate channel. Continuing to use the service after the effective date means you accept the update. If you disagree, stop using the service and cancel future renewal.
14. Governing law and disputes
These Terms are governed by the law of the place where the operator is established, without removing mandatory consumer rights available where you live. The parties should first try to resolve disputes in good faith through official support. Unresolved disputes may be submitted to a court or authority with lawful jurisdiction.
15. General
If any provision is invalid, the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not assign this agreement without our written consent; we may assign it as part of a merger, reorganisation, or business transfer.
